Terms & Conditions

Welcome to TOV Rentals. By placing a rental order and accepting delivery, you agree to the following Terms & Conditions. Please read carefully before renting.

  1. Rental Term

    • Your rental period begins on the delivery date and runs for the duration you select at checkout (typically 3–24 months).
    • Extensions must be requested in writing and approved by TOV.
    • The Agreement becomes binding upon order confirmation.

  2. Billing & Payments

    • Rental fees are billed every 30 days, in advance, to the payment method on file.
    • You must maintain a valid payment method. A 7-day grace period applies for failed payments.
    • Late payments: $25 fee plus 1.5% monthly interest (or the maximum allowed by law).
    • After 30 days past due, additional late fees and collection charges may apply.
    • You authorize TOV to charge your card for rental fees, damages, early termination penalties, or related costs.
    • Taxes and regulatory fees are additional.

  3. Account Responsibilities

    • Keep your contact and billing details accurate.
    • All notices will be sent to the email or address on file.
    • You are responsible for all activity under your account.

  4. Delivery & Scheduling

    • Delivery and assembly are offered in NYC’s five boroughs, weekdays 9AM–6PM.
    • Delivery times are estimates; delays may occur due to weather, traffic, or building restrictions.
    • You (or an adult with ID) must be present to sign for delivery.
    • Missed deliveries or missing COIs/elevator access may result in fees up to $300.
    • Failed delivery attempts due to inaccessibility: $75 restocking fee per item.
    • Ensure furniture fits through all entryways.
    • Report delivery issues within 24 hours.

  5. Usage & Care

    • Furniture is for indoor residential use only unless otherwise approved.
    • No altering, subletting, or relocating without TOV’s written consent.
    • You are responsible for damage beyond normal wear (pets, smoking, stains, fire, water, etc.).
    • TOV may repair or replace items at its discretion.
    • Intra-city relocation may be available for a fee.

  6. Deposits & Damage

    • A refundable deposit may be required based on order size or credit check.
    • Excessive damage will be charged against your deposit or card on file.
    • Furniture remains TOV property at all times and may not be sold, pledged, or abandoned.
    • Damage fee schedules available upon request.

  7. Cancellations & Early Exit

    • Orders canceled 48 hours before delivery are fully refundable.
    • Early termination requires 30 days’ written notice plus two months’ rent or the remaining balance (whichever is less).
    • If TOV cannot retrieve items due to denied access, you will be charged full replacement value.

  8. End of Term & Returns

    • Provide at least 7 days’ notice to schedule pickup.
    • Furniture must be accessible and in reasonable condition.
    • Inaccessible or unreturned furniture may be deemed abandoned and charged at replacement value.
    • Purchase options may be available upon request.

  9. Risk of Loss & Insurance

    • You assume all risk of loss, theft, or damage, regardless of cause.
    • Renters’ insurance or a TOV damage waiver is strongly encouraged.
    • Loss or damage does not release you from payment obligations.

  10. Breach & Remedies

    • Default includes missed payments, excessive damage, unauthorized relocation, or failure to return items.
    • On default, TOV may terminate this Agreement, recover furniture, and charge amounts due.
    • You must allow access for retrieval as legally permitted.

  11. Misuse & Non-Return

    • Withholding furniture valued over $100 without return may result in legal action under NY Penal Law §165.15.
    • Prior written demand for return will be issued before any action.
    • Failure to return furniture within 30 days of notice may result in criminal or civil penalties.

  12. Indemnification

    You agree to indemnify and hold harmless TOV, its officers, employees, and contractors from all claims, damages, or expenses (including attorney fees) arising from your use of rented furniture or breach of these Terms.

  13. Limitation of Liability

    TOV’s liability is limited to the total rental fees you have paid for the affected item(s). We are not liable for incidental, indirect, or consequential damages.

  14. Termination by TOV

    • TOV may terminate rentals at any time, with or without cause.
    • You will have 14 days from notification to return all furniture, or full replacement value will be charged.

  15. Final Terms

    • No verbal statements override these Terms unless confirmed in writing.
    • This Agreement is the entire understanding between you and TOV.
    • Invalid provisions do not affect the remainder.
    • Changes must be in writing, signed by both parties.
